EB-5 investor visa

The U.S. congress created a fifth preference of the Employment Based visa category in 1990 known as the EB-5 Immigrant Investor Program.

It was created by Congress to inject foreign capital into the U.S. economy from investors, in exchange for permanent residence in the United States.

In the program, an immigrant investor must make his or her investment in a new commercial enterprise, and his or her investment must directly result in the creation or preservation of 10 full time jobs for American citizens within a 2 year time frame from the moment an immigrant investor has his or her initial investor petition (I-526) approved, and continuing 2 years thereafter.

Since the programs inception in 1990, and specifically in the years following the U.S. economic recession beginning in 2008, it has shown tremendous growth in terms of immigrant investor participation, dollars of investment capital invested per annum, and perhaps most importantly, in terms of full time jobs directly and indirectly created for U.S. citizens as a result of the EB-5 Visa Program.
